Special Criminal Court Refuses To Dismiss Charges Against Lisa Smith

Lisa Smith’s lawyers have failed to convince the Special Criminal Court to dismiss the charges against her.

The former Irish soldier from Dundalk, Co Louth is accused of being a member of ISIS between 2015 and 2019 and of attempting to finance terrorism.

After the last prosecution witness was called, Lisa Smith’s barrister put forward his arguments as to why he believed the charges against his client should be dropped.

In relation to the allegation that she tried to finance terrorism through an €800 Western Union transfer in 2015, Michael O’Higgins accused the other side of not proving that the intended recipient was a member of ISIS or that he was within its territory at the time and he claimed that there was no proof of her intention or knowledge at the time.

Similarly, he criticised the evidence called to support their claim that Lisa’s decision to go to Syria that same year was motivated by her desire to become a member of ISIS.

However, the judges saw no basis as to why it would be unfair to proceed so Mr O’Higgins will call his first witness when the trial resumes on Monday.
