A jury has found a 25 year old man not guilty of assaulting a garda.
Stephen Touhey from Inglewood Drive in Dublin 15 denied spitting and punching the officer at Blanchardstown Garda Station and claimed the Garda actually assaulted him.
The Garda claimed Mr Touhey became agitated and began demanding a phone call.
He said he started banging on his cell door and covered the hatch view with a mattress.
When the officer went down to his cell to bring him to court, he claimed Mr Touhey lunged at him and then spat, kicked and punched him.
But Stephen Touhy denied this and said the officer actually punched him and said, "I have a can of pepper spray with your name on it".
The jury heard both sides and after just over an hour of deliberations they decided they believed Stephen Touhy and found him not guilty of assaulting the Garda.
