Lawyers for Ibrahim Halawa in Egypt have applied for the Firhouse teen's release.
The application was made based on a law, which says detainees held for more than two years without a hearing, should be freed.
The paperwork was filed yesterday when Ibrahim's mass trial was put back for the 9th time.
The adjournment was due to a number of defendants not being well enough to appear.
Minister for Foreign Affairs Charlie Flanagan says the embassy's support was conveyed directly to the judge, and he is now awaiting a response.
Maya Foa of human rights group Reprieve welcomes the application but says the issue needs to be raised at the "highest level", and is appealing to Enda Kenny to make a call "directly to his counterpart in Egypt".
