A woman, whose ex-boyfriend raped her in her sleep, is planning to ask the DPP to appeal the sentence because she feels it was too lenient.
Magnus Meyer Hustveit spent a week in custody before being released yesterday after being handed a fully suspended sentence for what he did.
Victims of rape are legally entitled to have their identities protected, but Niamh Ní Dhomnaill decided to waive her right to anonymity so that her ex, Magnus Meyer Hustveit, could be publicly named.
Yesterday, the 25-year-old Norwegian was handed a seven year sentence after admitting to raping her in her sleep in an apartment they shared three years ago.
The “deception and repetition” of the crime, as well as the effect on his victim warranted a severe sentence, according to Mr. Justice Patrick McCarthy BUT he suspended the sentence in full after considering a range of mitigating factors.
Niamh has spent the day raising awareness about what happened to her in the hope it will help others, and she’s now planning to ask the DPP to appeal the sentence:
A review will have to be requested within 28 days and will only be considered “unduly lenient” if the Court of Appeal believes the judge made a mistake on a legal point.
