A Finglas man claims he was provoked into killing his uncle.

David Cully of Kilsane Road admits shooting Edward O’Connor on the Ballycoolin Road in December 2013 but denies his murder.

On the night before Edward O’Connor was shot dead, his son’s ear was bitten during a pub fight with David Cully’s sister’s boyfriend.

A straightener was organised for the following day. Lots of people, including both the accused and his uncle showed up to watch the fight at a deserted yard on the Ballycoolin Road in Finglas.

When a few others tried to get involved, Cully, who’d brought a gun with him, fired a shot into the air to bring it to an end.

He then shot his uncle twice in the back as he tried to leave and he was pronounced dead in hospital a short time later.

The 24-year-old admits shooting him but denies his murder, claiming he didn’t mean to do what he did and just “lost it” after being provoked by a comment made about his sister.

The prosecution believes Mr. O’Connor wasn’t a threat and that the accused came to the fight armed with a gun and decided to kill him because the DPP had decided not to prosecute for sex allegations made by his sister.

The jury will hear from some eye witnesses tomorrow.
