McDonalds wants to be able to serve food until 3am in Temple Bar.
However its facing some local opposition.
McDonalds failed to secure the early morning extension after Dublin City Council ruled it would upset the balance of amenities in the area and have a negative impact on residents.
The fast food outlet has now appealed to an Bord Pleanala where it argues that the restaurant can play an important role in adding to the diversity of food options late at night.
It also points out that there are a number of take always already operating in Temple bar.
The city council refused permission after a number of local residents objected.
A decision is due later this year.
