Drimnagh Murderer Wants Conviction Overturned

A Drimnagh man who lured a teenager to his death by pretending to be a girl is trying to have his murder conviction overturned.

Marcus Kirwan of Cooley Road claims his arrest was unlawful and has raised concerns about the CCTV footage used during his trial.

Following his trial in 2013, Marcus Kirwan was jailed for life after being found guilty of murdering David Byrne in March 2011.

The court heard he lured him to Emmet Court in Inchicore by sending text messages pretending to be a teenage girl.

When Mr. Byrne arrived, he was chased into a dead end where he was stabbed nine times.

Kirwan’s lawyers appealed his conviction today, claiming his arrest was unlawful because the warrant wasn’t executed by the assigned Superintendent. The identification procedure used to identify him and the admissibility of CCTV footage are also among their grounds for appeal.

A decision on whether his conviction should be quashed will be made at a later date.
