Drimnagh Man Appeals Murder Conviction

A Drimnagh man who lured a teenager to his death by pretending to be a girl will find out today if he’s won an appeal against his murder conviction.

In July, Marcus Kirwan of Cooley Road argued his arrest was unlawful and his lawyers also raised concerns about CCTV footage used during his trial.

Marcus Kirwan was jailed for life after being found guilty of murdering David Byrne in March 2011.

The court heard he lured him to Emmet Court in Inchicore by sending text messages pretending to be a teenage girl, and chased him into a dead end where he was stabbed nine times.

His lawyers believe his conviction should be overturned.

Last July, they argued his arrest warrant was invalid because it wasn’t executed by the assigned Superintendent.

The identification procedure used to identify him and the admissibility of CCTV footage are also among their grounds for appeal, and a judgement is due to be delivered this morning.
