A great-grandmother, who was taken to court over a satellite dish outside her Terenure home, has had the case against her dismissed.

Anne Rudd’s family bought it for her 90th birthday, but she was ordered to take it down because she didn't have planning permission.

Anne Rudd’s lawyer told the judge today that justice would not be served if a 90-year-old woman, who receives a pension of just €230 a week, was ordered to pay a €1,500 legal bill.

The dish was put up outside her home on St. Enda’s Road in Terenure without planning permission, and the council took her to court for failing to take it down within the required time.

It’s since been taken down, but the council wanted her to pay almost 70% of their legal costs. Judge John O’Neill accepted the council had done everything by the book but didn’t feel she should have to bear the “substantial bill” and dismissed her case without making an order for costs.
