Supermacs says it'll fight an EU decision in the trademark row with McDonalds.

The ruling means the Irish fast food chain can keep its brand name, but can't sell burgers.

Two years ago McDonalds filed a complaint about Supermac's bid to trademark its name, as part of plans to expand into Europe.

Yesterday a ruling was issued which allows them to keep the name, but not to sell fast food like burgers and chicken nuggets.

EU officials said customers could be confused by the items being offered by the two rivals.

Supermacs founder Pat McDonagh says he can't understand the ruling "the EU have to come up with their own reasons for that decision. We'll be looking to find out why they came up with that decision".

It's a blow for the Irish company at a time when it plans to move into the Australian market.

McDonalds is pleased with the ruling saying like any company, it wants to defend the values of its brand and stop others from taking unfair advantage of its trademarks.
