Not one driver has been prosecuted for texting while driving since the law was introduced last May.
The legislation was brought in to close a loophole which meant drivers escaped fines and penalties if they were texting using a hands free kit.
Now motorists caught texting while driving can get a court summons and a fine instead of just penalty points.
However no prosectuion has been taken under the new law, nine months after its introduced.
Several members of the traffic corps said they were not surprised the law is not being used due to the complexity of gathering evidence.
Gardai say unless you see the person in action you have no chance of a prosecution.
