No Jail For Man Who Raped Girlfriend As She Slept

A Norwegian man who raped his girlfriend while she was asleep will be released from custody today after he was handed a suspended sentence.

Magnus Meyer Hustveit of Leo Street, Dublin 7 was arrested in July 2012 after admitting what he’d done in an email.

In an emotional Victim Impact Statement, Magnus Meyer Hustveit’s ex-girlfriend said she still has nightmares about what happened and no longer sees her bed as a place of “rest and sanctuary”.

She moved in with him a few months after they met at a bar on Dame Street in May 2011. The following Easter, she said she awoke one night and realised he’d had sex with her while she was asleep.

After she left him, the 25-year-old IT worker sent her a lengthy Email admitting what he’d done. He was arrested after she showed it to Gardai.

Today, Mr. Justice Patrick McCarthy said he’d never come across such a case and while he had to take into account the deception and effect of what he did; he couldn’t ignore his admissions and the fact he came back to Ireland to be prosecuted.

Mr. Hustveit then cried and embraced his current girlfriend after he was handed a fully suspended seven year sentence.
