Justice Minister Frances Fitzgerald is due to update the Cabinet this morning on the surveillance of journalists' phones.

It's after it was revealed that two journalists had their phone records accessed by the Garda Ombudsman.

New legislation brought in last year gave GSOC the same power as Garda Superintendents to access phone and e-mail records.

Last week it emerged that these powers had been used to access the phones of two journalists without their knowledge after complaints about reports on the death of model Katy French.

Taoiseach Enda Kenny yesterday called for an overhall of the laws saying they were valid in cases of national security but were not in place to monitor the phones of reporters.

There has been criticism of GSOC since the revelations, with the Health Minister saying it would be 'odd and sinister' if any government body was accessing the phones of journalists.

GSOC have so far refused to comment on the situation.
