A Tallaght man has been sentenced to 18 months in jail for dangerous driving causing the death of his best friend.
23 year old Kevin McCarthy of Rossfield Drive was driving at up to twice the speed limit when his car collided with trees on the N81 near Brittas. The victim’s family say they are disgusted with the justice system following the sentence.
Dublin Circuit Criminal Court heard in May 2014, Kevin McCarthy was driving on a winding road with his friend Thomas Carroll (21) in the back when the car spun out of control and hit some trees.
It flipped over twice, spun around about 10 times, before coming to rest on the wrong side of the road.
Thomas, who was a dad of one, suffered serious head injuries and was pronounced dead at the scene.
The court heard McCarthy, hadn’t been drinking, but had been doing up to twice the speed limit. He took to the witness box and cried uncontrollably as he apologised to the victim's family for the crash.
''I'm very sorry about everything that happened. It was all my fault.'' he said. McCarty’s sister Siobhan told the court for months after the crash her brother would disappear and it turned out he was going back to the scene of the collision, to where his best friend died, to speak to him.
McCarthy, who pleaded guilty, has 73 previous convictions - mostly for road traffic offences. The offences include 12 convictions for not having an NCT, 18 convictions for not having a driving licence, one conviction for no insurance and one conviction for careless driving. He was jailed for four years with two and a half suspended.
Speaking outside court the victim’s mum Nicola said the family are unhappy with the sentence: ‘’We would just like to say we are disgusted by the justice system in Ireland. A year and a half is simply not enough for our beloved son, brother and daddy to our granddaughter, Kayla, who will grow up without her dad.''
Kevin McCarthy will walk free in a year and a half and live his life as normal while we will suffer a life sentence.’’
She added ''Thomas was the nicest person. He would do anything for you. He was always laughing and joking’’.
